And how can we best implement these in practice? \nThis introductory training for newly elected works council members provides basic knowledge about the central tools of works council work. It also provides guidance on how to organise decision-making processes in order to enable the committee to best represent the interests of employees. \nWorks Constitution Act – legal basis\nThe Works Constitution Act (WCA) forms the legal basis for the establishment and organisation of works council work. It serves to promote democracy and employee participation in companies. In addition to protecting works council members\, the WCA regulates detailed procedural processes to ensure the democratic nature of works council work. \nIn this training\, we will familiarise ourselves with these basics and talk about the role\, self-image\, tasks and duties of works council members in the context of their mandate. \nCo-determination as a central task\nCo-determination in social\, personnel and economic matters is a central component of works council work. We provide an introduction to the Works Constitution Act and the German industrial relations system. The general tasks of the works council according to Sec. 80 WCA are dealt with and practical suggestions for the organisation of works council work are given. How can employee representatives ensure that digital tools are used in ways that are fair\, transparent and compliant with data protection law? And what changes when the system in question is not simply new software\, but an application powered by artificial intelligence? \nThe digitalisation of the workplace confronts works councils with growing demands: new IT systems are introduced in rapid succession\, data on employee behaviour and performance is collected on an ever-larger scale\, and AI-based applications are increasingly used to support or automate operational decisions. This training equips works council members with the knowledge and practical tools to effectively exercise their co-determination rights in this field. \nCo-determination when IT systems are introduced – the legal framework\nThe introduction or modification of technical systems capable of monitoring employee behaviour or performance triggers mandatory co-determination rights under Sec. 87 (1) No. 6 WCA. This applies to a wide range of systems: from email and office communication platforms to time-recording tools\, workforce management systems and cloud-based collaboration environments. The works council must be involved from the outset – not merely informed after decisions have been taken. \nThe training provides a systematic overview of the relevant participation rights under the Works Constitution Act (WCA) and discusses how they interact with the requirements of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). Particular attention is paid to the use of works agreements as the central regulatory instrument\, including provisions on data protection\, the prohibition of performance and behaviour monitoring\, and the governance of digital working tools. \nArtificial intelligence – a special case within IT co-determination\nAI-based systems are not categorically different from other IT applications in terms of the applicable co-determination rights: the same provisions of the WCA apply. What makes AI a special case is the nature and scale of the challenges it poses: the opacity of algorithmic decision-making\, the depth of data processing involved\, and the potential for far-reaching effects on working conditions\, work design\, qualification requirements and employment. \nThis training therefore provides an introductory overview of AI co-determination – sufficient to recognise AI applications in the workplace\, understand the works council’s basic rights in this context\, and identify the implications for work design and skills requirements. In addition\, personnel planning involves long-term strategic considerations that have a direct impact on the workforce. In this training\, we provide practical information on how works councils can effectively utilise their right to participate in individual personnel measures and strategic personnel planning and how the individual employment relationship of employees is linked to the collective participation rights of the committee. \nPrinciples of co-determination for individual personnel measures\nThe Works Constitution Act (WCA) provides for comprehensive participation rights of the works council in individual personnel measures. How is OSH organised within the company – and who are the key actors the works council needs to work with? \nThis training provides works council members with the essential legal foundations and practical tools to fulfil their OSH mandate effectively. It introduces the statutory framework\, the structure of in-company OSH organisation\, and the co-determination and participation rights of the works council in this field. \nThe statutory OSH framework\nOccupational safety and health in Germany rests on a layered legal framework. The Occupational Safety and Health Act (Arbeitsschutzgesetz – ArbSchG) constitutes the central piece of legislation: it places the employer under a general duty to assess workplace risks and take appropriate preventive measures. It is complemented by the Occupational Safety Act (Arbeitssicherheitsgesetz – ASiG)\, which governs the appointment and tasks of occupational physicians and OSH professionals (Fachkräfte für Arbeitssicherheit)\, as well as by the Workplace Ordinance (Arbeitstättenverordnung – ArbStättV) and the accident prevention regulations issued by the statutory accident insurance funds (DGUV Vorschriften). \nIn this training\, we examine how this framework is structured and what it means for the day-to-day work of the works council. \nCo-determination in OSH as a central task\nOSH is one of the areas in which the works council has particularly strong participation rights. Under Sec. 87 (1) No. 7 WCA\, the works council has mandatory co-determination rights on rules relating to the prevention of accidents and occupational diseases and on the protection of health. In addition\, Sec. 89 WCA imposes an active duty on the works council to promote OSH within the company. \nWe provide a systematic overview of the works council’s rights – from general monitoring duties under Sec. 80 WCA to concrete co-determination and enforcement options – and give practical guidance on how to use them. \nOSH organisation and the Occupational Safety and Health Committee\nEffective OSH requires clear organisational structures in the company. The training covers the roles and responsibilities of the key OSH actors – the employer\, OSH professionals\, occupational physicians\, and the works council – and how they interact. And how can we best implement these in practice? \nThis introductory training for newly elected works council members provides basic knowledge about the central tools of works council work. It also provides guidance on how to organise decision-making processes in order to enable the committee to best represent the interests of employees. \nWorks Constitution Act – legal basis\nThe Works Constitution Act (WCA) forms the legal basis for the establishment and organisation of works council work. It serves to promote democracy and employee participation in companies. In addition to protecting works council members\, the WCA regulates detailed procedural processes to ensure the democratic nature of works council work. \nIn this training\, we will familiarise ourselves with these basics and talk about the role\, self-image\, tasks and duties of works council members in the context of their mandate. \nCo-determination as a central task\nCo-determination in social\, personnel and economic matters is a central component of works council work. We provide an introduction to the Works Constitution Act and the German industrial relations system. The general tasks of the works council according to Sec. 80 WCA are dealt with and practical suggestions for the organisation of works council work are given. Which hazards must be assessed\, and how do physical-technical risks differ from psychosocial ones? \nThis training builds on the foundations covered in OSH 1 and focuses on the risk assessment (Gefährdungsbeurteilung) as the core instrument of preventive occupational safety and health. Participants will gain the knowledge and practical tools needed to actively shape and monitor the risk assessment process in their company – including both physical-technical and psychosocial hazards\, which have been a mandatory component of the risk assessment under the Occupational Safety and Health Act (ArbSchG) since 2013. \nRisk assessment as a statutory duty\nUnder Sec. 5 ArbSchG\, employers are required to assess the hazards associated with all work activities and to derive and implement appropriate preventive measures. The risk assessment must cover the full range of potential hazards – from physical loads\, noise\, chemical substances and workplace design to working time arrangements\, work organisation and\, explicitly\, psychosocial stressors. The works council has mandatory co-determination rights in this process under Sec. 87 (1) No. 7 WCA and can exercise an initiative right to demand that a risk assessment be carried out or updated. \nPhysical-technical hazards\nThe training covers the main categories of physical-technical hazards at the workplace – mechanical risks\, noise and vibration\, climatic conditions\, lighting\, ergonomic deficiencies\, and hazardous substances – and equips works council members to exercise their co-determination rights effectively when these hazards are identified\, assessed and addressed by the employer. We examine the relevant legal requirements under the ArbSchG\, the Workplace Ordinance (ArbStättV)\, the Ordinance on Industrial Safety and Health (BetrSichV) and the applicable Technical Rules\, and discuss how the works council can use the results of the risk assessment to push for concrete protective measures. \nPsychosocial hazards and work-related mental health\nPsychosocial hazards – such as high workload\, time pressure\, lack of autonomy\, social conflicts or permanent availability – are a leading cause of work-related ill-health. Their assessment as part of the risk assessment is legally required but in practice often neglected or carried out inadequately. In this training\, we provide practical information on how works councils can effectively utilise their right to participate in individual personnel measures and strategic personnel planning and how the individual employment relationship of employees is linked to the collective participation rights of the committee. \nPrinciples of co-determination for individual personnel measures\nThe Works Constitution Act (WCA) provides for comprehensive participation rights of the works council in individual personnel measures. They can be gradual and barely noticeable\, yet profound and effective – or they can suddenly appear as drastic and sensational reorganisations. Work processes are fundamentally changed\, departments restructured or outsourced\, and jobs are often jeopardised. Work content and conditions almost always change\, and new demands are placed on employees. \nWhat rights and obligations does the works council have in such situations? How can it recognise changes at an early stage and effectively exercise its co-determination rights in order to influence corporate planning? This training provides practical information on how works councils can act in the event of operational changes in accordance with Sec. 111 ff. WCA. It provides a sound introduction to the legal regulations\, the role of the works council and the Finance Committee as well as the negotiation of reconciliation of interests and social plans. \nWe also familiarise ourselves with the economic framework conditions at company level and their far-reaching effects. Corporate restructuring through share deals\, asset deals and reorganisations under the German Transformation Act (Umwandlungsgesetz) will also be discussed. We also examine the consequences under employment law in accordance with Sec. 613a of the German Civil Code (BGB) and their impact on the workforce. \nParticipation rights of the works council in the event of operational changes\nThe Works Constitution Act regulates the participation rights of the works council in the event of organisational changes. This includes in particular \n\nInformation and consultation rights: early involvement in restructuring processes\nNegotiation of a reconciliation of interests and\, if necessary\, an enforceable social plan: Design of transitional arrangements and protective measures for employees\nInfluence on economic decisions: Information and consultation rights via the Finance Committee\n\nThe aim of the training is to enable works councils to actively exercise their co-determination rights and effectively represent the interests of the workforce. \nReconciliation of interests and social plan – legal basis and practice\nA reconciliation of interests describes the planned operational changes\, while the social plan serves to mitigate the consequences for the employees. The training covers the following aspects: \n\nDefinition and function of the reconciliation of interests (Sec. 112 WCA)\nImportant content and negotiation techniques\nRelevant regulations on social compensation plans (Sec. 112 WCA and Sec. 112a WCA)\nDealing with dismissals and collective redundancies (Sec. 17 KSchG)\n\nPractical examples will be used to work out how works councils can use these instruments strategically. \nCooperation between the works council and the Finance Committee\nCoordination with the Finance Committee is a decisive factor for successful participation in economic matters.
