Whether working time regulations\, holiday planning or the introduction of technical systems – the works council can play an active role in shaping these matters and proactively enforce company agreements. This training provides practical education on how works councils can strategically and effectively exercise their co-determination rights in social matters. A special focus is placed on participation-orientated works council work and effective negotiation. \nFundamentals of co-determination in social matters\nThe Works Constitution Act (Sec. 87 WCA) regulates the participation rights of the works council in social matters. These include in particular \n\nWorking time regulations: Organisation of shift schedules\, overtime regulations and working time models\nCompany policies and conduct of the employees: definition of rules of operation and behavioural guidelines\nIntroduction and use of technical equipment: Participation in the introduction of new digital systems and work equipment\nRemuneration systems: Designing and changing performance-related remuneration systems\n\nUsing practical examples and case studies\, participants learn how to successfully assert their co-determination rights. \nWorks agreements as an instrument of co-determination\nCompany agreements are the central means for the co-determination rights of employee representatives. The training deals with the following aspects: \n\nSuccessful negotiation of works agreements (Sec.Sec. 77 and 88 WCA)\nStructure and content of works agreements\nTermination and after-effect of works agreements\nRelationship between collective agreements and works agreements\nDifference between enforceable and voluntary works agreements\n\nThe aim is to provide works council members with in-depth knowledge of the legal framework and the scope for negotiating works agreements. \nNegotiation strategies and enforcement of co-determination\nSuccessful works council work requires skilful negotiation skills and targeted enforcement strategies. Only a works council that is firmly anchored in the workforce can achieve the best possible results in its negotiations with the management. This is why the training also deals with issues relating to participation procedures and public relations work by the works council. \nIn this training we’ll discuss: \n\nVarious participation levels and formats discussed\nMethods for organising transparent decision-making processes in the works council presented\nAnd ideas are discussed in order to develop viable solutions with the workforce\n\nThrough practical training and advice\, we support works councils in successfully exercising their co-determination rights and building a strong representation of interests. \nOur training focusses on the following topics: \n\nCo-determination in accordance with Sec. 87 WCA\nStructure and organisation of works agreements\nParticipation-oriented works council work\nOrganisation and structuring of works council work\nNegotiation skills and techniques\n\nYour Registration\nRegister here\n\n \n\n\n\n\n\n\n\n\nRegistration is possible before passing a resolution to reserve your seat. They can be gradual and barely noticeable\, yet profound and effective – or they can suddenly appear as drastic and sensational reorganisations. Work processes are fundamentally changed\, departments restructured or outsourced\, and jobs are often jeopardised. Work content and conditions almost always change\, and new demands are placed on employees. \nWhat rights and obligations does the works council have in such situations? How can it recognise changes at an early stage and effectively exercise its co-determination rights in order to influence corporate planning? This training provides practical information on how works councils can act in the event of operational changes in accordance with Sec. 111 ff. WCA. It provides a sound introduction to the legal regulations\, the role of the works council and the Finance Committee as well as the negotiation of reconciliation of interests and social plans. \nWe also familiarise ourselves with the economic framework conditions at company level and their far-reaching effects. Corporate restructuring through share deals\, asset deals and reorganisations under the German Transformation Act (Umwandlungsgesetz) will also be discussed. We also examine the consequences under employment law in accordance with Sec. 613a of the German Civil Code (BGB) and their impact on the workforce. \nParticipation rights of the works council in the event of operational changes\nThe Works Constitution Act regulates the participation rights of the works council in the event of organisational changes. This includes in particular \n\nInformation and consultation rights: early involvement in restructuring processes\nNegotiation of a reconciliation of interests and\, if necessary\, an enforceable social plan: Design of transitional arrangements and protective measures for employees\nInfluence on economic decisions: Information and consultation rights via the Finance Committee\n\nThe aim of the training is to enable works councils to actively exercise their co-determination rights and effectively represent the interests of the workforce. \nReconciliation of interests and social plan – legal basis and practice\nA reconciliation of interests describes the planned operational changes\, while the social plan serves to mitigate the consequences for the employees. The training covers the following aspects: \n\nDefinition and function of the reconciliation of interests (Sec. 112 WCA)\nImportant content and negotiation techniques\nRelevant regulations on social compensation plans (Sec. 112 WCA and Sec. 112a WCA)\nDealing with dismissals and collective redundancies (Sec. 17 KSchG)\n\nPractical examples will be used to work out how works councils can use these instruments strategically. \nCooperation between the works council and the Finance Committee\nCoordination with the Finance Committee is a decisive factor for successful participation in economic matters. The training covers: \n\nFunction and tasks of the Finance Committee\nEffective communication between the works council and the Finance Committee\nAnalysing economic key figures for better negotiation management\n\nBy providing practical training and advice\, we support works councils in effectively exercising their participation rights during restructuring and shaping long-term solutions for the workforce. \nThe training covers the following main topics \n\nGeneral tasks of works councils in connection with operational changes\nWhat does participation in operational changes mean?\nNegotiation of a reconciliation of interests and social plan\nDismissals for operational reasons and collective redundancy procedures\nThe role of the Finance Committee in operational changes\nReorganisations at company level (share deal\, asset deal\, UmwG)\nThe transfer of business and the legal consequences of Sec. 613a BGB\n\nDetailed Training Contents\n\nAlterations\n\n\nIntroduction to Sec. 111 WCA\nDefinitions and possibilities of the works council\nInformation and consultation rights\n\n\nThe reconciliation of interests and social plan\n\n\nDefinition and function of the reconciliation of interests\nFunction and contents of a social compensation plan (Sec. 112 WCA)\nExcursus on collective redundancies pursuant to Sec. 17 KSchG\n\n\nNegotiation of reconciliation of interests and social plan\n\nBasics of conducting negotiations for operational changes\nPhase model for targeted influencing of operational changes\nReconciliation of interests\, social plan and works agreements\n\n\n\n\nIndemnities (Sec. 113 WCA)\nThe Finance Committee as an early warning instrument for operational change and its cooperation with the works council\n\n\nAppointment and composition of the Finance Committee (Sec.Sec. 107 ff.
